Terms and Conditions of Sale
1. Introduction
These Terms and Conditions (“Terms”) govern all online sales made by ATI Accurate Technologies India Pvt. Ltd (“Seller”) to business or consumer customers (“Buyer”) through our India e-store. By placing an order, the Buyer agrees to be bound by these Terms.
2. Products
Products include data acquisition hardware, dataloggers, CANbus tools, and related equipment. Descriptions and specifications are subject to change without notice.
3. Orders and Acceptance
Orders constitute an offer to purchase products. Acceptance occurs only upon written confirmation or dispatch of goods.
4. Prices and Payment
Prices displayed are in Indian Rupees (INR) and include GST unless otherwise stated. Payment must be made in full before dispatch.
Payment processing is handled by third-party providers. We do not store full card information.
5. Delivery Delivery
timelines are indicative only. Risk in goods passes to the Buyer upon delivery; ownership passes upon full payment.
6. Right of Cancellation (Consumer Sales)
Consumers may cancel within 7 working days of receipt, in accordance with the Consumer Protection (E-Commerce) Rules, 2020, and applicable Indian law. Details of the cancellation and return procedure are provided separately in the Returns Policy.
7. Warranties and Disclaimers
Products are warranted to materially conform to their specifications at the time of delivery. Except as expressly provided, all warranties (including merchantability or fitness for a particular purpose) are disclaimed to the fullest extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, the Seller’s total aggregate liability for any claim shall not exceed the price paid for the goods in question. Nothing herein excludes liability for death, injury, fraud, or other liability that cannot be excluded under applicable Indian law.
9. Force Majeure
We are not liable for delays or failure to perform due to events beyond reasonable control, including natural disasters, strikes, or governmental actions.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. The courts at Bangalore, Karnataka shall have exclusive jurisdiction.
11. Acceptance of Terms – Checkout Consent
At checkout, customers must confirm acceptance of these Terms by ticking the following box: “I confirm that I have read and agree to the Terms and Conditions of Sale.”
